Synopsis

1st Topic by Mr Ho Chien Mien on the impact of Covid-19 (Temporary Measures) Act (COTMA) on delays and disruptions to projects;  claims for, and assessment of, EOT under the SIA forms of contract, and the survival of   force majeure  as a ground for claiming EOT independent of COTMA.

2nd Topic by Mr Kelvin Kek on the assessment process under COTMA, the role of assessors appointed under the Act, and the relationship between assessments under COTMA and assessments by the contractor administrator under the contract.

Speakers

Mr Ho Chien Mien, Co-Head of Allen & Gledhill’s Construction & Engineering Practice
Chien Mien is Co-Head of Allen & Gledhill’s Construction & Engineering Practice.

In 2018, he was among the inaugural batch of select practitioners to be recognised as a Senior Accredited Specialist in Building and Construction Law by the Singapore Academy of Law.

Chien Mien undertakes a wide range of contentions and non-contentious construction and engineering related work. On the contentious side, he has extensive litigation, arbitration, adjudication and mediation experience – both domestic and international. On the non-contentious side, he has been involved in some of the largest building and infrastructure projects in Singapore and the Asia Pacific region.

He sits on the main panel of arbitrators for the Singapore International Arbitration Centre and the Asian International Arbitration Centre. Chien Mien is also a Senior Accredited Adjudicator with the Singapore Mediation Centre, a Fellow of the Singapore Institute of Arbitrators and a member of Singapore Infrastructure Dispute Management Protocol Advisory Committee.

Mr Kelvin Kek, Allen & Gledhill LLP
Kelvin is a Partner in Allen & Gledhill LLP, one the biggest law firms in Singapore. His work is often cross border in nature and matters often necessitate travel to other jurisdictions like Malaysia, Indonesia and India. Kelvin is a specialist in construction arbitration and has acted for many multinational corporations and government-linked entities in disputes concerning complex construction claims, both in Singapore and abroad. Other areas of expertise include JV-related disputes, directors’ duties, shareholder disputes and property related claims.
Kelvin graduated from the National University of Singapore with an LLB (First Class Honours) degree. He is called to both the Singapore and New York State Bar. He is also a Mediator accredited by the Singapore Mediation Centre. Prior to pursuing his legal career, Kelvin graduated from the National University of Singapore with a first degree in Electrical & Electronic Engineering.
